Terms and Conditions for Luggage Drop Website and App

Arbitration Agreement:

Any dispute arising from or in connection with these Terms and Conditions or the use of the Luggage Drop website or app shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1-16.

Luggage Drop Services Overview:

Luggage Drop offers a variety of services to help travelers store, transport, and manage their luggage and personal belongings. These services may include, but are not limited to:

  • Storage Services: Luggage Drop provides secure, short-term storage solutions for travelers who need to temporarily store their luggage while they are in transit or during a layover.
  • Delivery Services: Luggage Drop offers delivery services to help travelers transport their luggage to and from their destination. This may include pickup and drop-off services at airports, hotels, or other locations.
  • Shipping Services: Luggage Drop provides shipping services for travelers who need to send their luggage or personal belongings to a different location.
  • Repair Services: Luggage Drop offers repair services for damaged luggage and personal belongings.
  • Package Acceptance Services: Luggage Drop allows travelers to have packages delivered to our location for safekeeping until they can be picked up.
  • Other Services: Luggage Drop may offer other services as needed or requested by customers.

Eligibility:

The Luggage Drop website and app are intended for use by travelers who are at least 18 years old. By using our services, you represent and warrant that you meet this age requirement and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions.

Accounts & Registration: In order to use certain features of the Luggage Drop website and app, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password.

Payments: All payments for Luggage Drop services must be made through the website or app using a valid payment method. Luggage Drop reserves the right to change the fees for our services at any time.

Pricing: The fees for Luggage Drop services will be displayed on the website and app at the time of booking. These fees may vary based on the type of service, location, and other factors.

Safety & Security Fee: In order to ensure the safety and security of your luggage and personal belongings, Luggage Drop may charge a Safety & Security Fee. This fee will be displayed on the website and app at the time of booking and is in addition to any other fees for Luggage Drop services.

Authorization: By using the Luggage Drop website or app, you authorize Luggage Drop to charge your payment method for any fees or charges associated with the services you have booked.

Delinquent Accounts: If your payment is declined or your account becomes delinquent, Luggage Drop reserves the right to terminate or suspend your access to our services.

Waiver: Luggage Drop will not be liable for any loss or damage to your luggage or personal belongings while they are in our care. By using our services, you waive any claims against Luggage Drop for such loss or damage.

Luggage Drop Coupons: Luggage Drop may offer coupons or discounts from time to time. These coupons and discounts may have certain terms and conditions, including expiration dates and restrictions on use. It is your responsibility to review and comply with the terms and conditions of any coupons or discounts you use.

Cancellation Policy: Since most of our locations have limited space available, services for storage, delivery or any other service provided are based on our reservations. Any cancellation must be requested in writing at least 24 Hours before your scheduled drop off time to request any future service credit. Luggage Drop may at its discretion refund the original payment method if extenuating circumstances exist, however the refund amount will be reduced by any applicable payment processing fee. No refund or cancellation will be allowed within 24 hours of your check in time.

Prohibited Items: Luggage Drop does not allow the storage or transportation of certain items, including but not limited to: illegal or hazardous materials, perishable goods, living animals, and valuable items such as jewelry or cash. Luggage Drop will not be liable for any loss or damage to prohibited items.

Drop Guard Coverage: Luggage Drop may offer optional Drop Guard Coverage for an additional fee. This coverage provides financial compensation for loss or damage to your luggage and personal belongings while they are in our care, up to a coverage limit of $2500 per reservation. The terms and conditions of Drop Guard Coverage, including exclusions and limitations, will be made available to you at the time of purchase.

Excluded Items: Drop Guard Coverage may exclude certain items from coverage, including but not limited to: illegal or hazardous materials, perishable goods, living animals, and valuable items such as jewelry or cash. It is your responsibility to review and understand the exclusions and limitations of Drop Guard Coverage.

Burden of Proof: In the event of a claim under Drop Guard Coverage, it is your responsibility to provide evidence of the loss or damage, including receipts and other documentation.

Cooperation: In the event of a claim under Drop Guard Coverage, you agree to cooperate fully with Luggage Drop in the investigation and resolution of the claim.

Limited License: Luggage Drop grants you a limited, non-exclusive, non-transferable license to access and use the website and app for the purpose of booking and using our services. This license does not allow you to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the website or app.

Ownership & Proprietary Rights: The website and app and all content, including but not limited to text, graphics, images, and software, are the property of Luggage Drop and are protected by copyright and other intellectual property laws. Luggage Drop reserves all rights not expressly granted in these Terms and Conditions.

User Content: You may be able to submit comments, reviews, or other content (“User Content”) to the website or app. By submitting User Content, you grant Luggage Drop a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, modify, publish, translate, distribute, and display your User Content in any media. You represent and warrant that you own or have the necessary rights to submit the User Content and that it does not violate any laws or the rights of any third party.

Limited License Granted to Luggage Drop: By using the website or app, you grant Luggage Drop a limited, non-exclusive, royalty-free, worldwide license to use any information, materials, or ideas you provide to us for the purpose of providing our services.

Communications: Luggage Drop may communicate with you through email, SMS messages, push notifications, or phone calls for the purpose of providing our services or for other purposes as disclosed in our Privacy Policy. By using our services, you consent to receiving these communications.

Prohibited Conduct: You are strictly prohibited from engaging in any conduct that could damage, disable, overburden, or impair the website or app or interfere with any other party’s use and enjoyment of the website or app. This includes, but is not limited to, hacking, spamming, and using the website or app for any illegal or unauthorized purpose.

Luggage Drop makes no representations or warranties of any kind, express or implied, as to the operation of the website or app or the information, content, materials, or products included on the website or app. Luggage Drop does not warrant that the website or app will be uninterrupted or error-free.

Limitations of Liability: Luggage Drop will not be liable for any damages of any kind arising from the use of the website or app, including but not limited to direct, indirect, incidental, punitive, and consequential damages. This limitation of liability applies to all damages of any kind, including but not limited to those resulting from loss of use, data, or profits, or any unauthorized access to or alteration of your transmissions or data.

Dispute Resolution: Any dispute arising from or in connection with these Terms and Conditions or the use of the website or app shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

No Class Actions: You may not bring a class action or other representative action against Luggage Drop, and you may not participate in a class action or other representative action against Luggage Drop.

Governing Law: These Terms and Conditions and your use of the website and app shall be governed by and construed in accordance with the laws of the State of New York, United States, without giving effect to any principles of conflicts of law.

No Support Requirement: Luggage Drop is under no obligation to provide support or maintenance for the website or app.

Notice Regarding Apple Devices: If you access the website or app through an Apple device, you acknowledge that these Terms and Conditions are between you and Luggage Drop, and not with Apple. Apple is not responsible for the website or app or its content. Apple has no obligation to furnish any maintenance or support services with respect to the website or app. If the website or app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price for the website or app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the website or app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Luggage Drop’s responsibility. Apple is not responsible for addressing any claims by you or any third party relating to the website or app or your possession and use of the website or app, including but not limited to: (i) product liability claims; (ii) any claim that the website or app fails to conform.

Terms of Service for Public Events

Welcome to Luggage Drop Events! We are a service that provides bag drop, phone charging, and other storage services at public events. By using our services, you agree to be bound by the following terms and conditions:

Luggage Drop Services: Luggage Drop offers bag drop, phone charging, and other storage services at public events. We do not store any illegal items, including but not limited to drugs, alcohol or tobacco products from minors, or stolen property. If our staff becomes aware of any illegal items in a bag being stored with us, we reserve the right to report this to the appropriate authorities. Our staff must also be made aware of all firearms and other weapons inside of bags being stored with us so that the item(s) can be secured properly. We reserve the right to inspect any bags and items our staff deems suspicious or a potential threat to public safety.

Refusal of Service: Luggage Drop reserves the right to refuse service to any individual without cause.

Damage to Property: Luggage Drop is not responsible for any damage to property caused by the spilling, malfunction, or explosion of other property within the same piece of luggage or bag, nor are we responsible for damage caused by “Normal Wear and Tear” which might arise from the moving and storing of your items on shelves . Any damage must be reported and documented prior to your departure from our staff.

Additional Storage Fees: Luggage Drop reserves the right to charge customers for an additional day of storage fees for each period of 24 hours that an item is not retrieved by its owner.

Abandoned Items: Luggage Drop will consider any item left in our possession for 30 days or more abandoned. All abandoned items will become property of Luggage Drop. Luggage Drop reserves the right to charge customers with 30 days of storage fees between the time of drop off and abandonment.

Claim Tickets: Luggage Drop will only return bags and personal items to the individual(s) who possess the claim ticket(s) that matches the tags assigned to each bag or item.

Mobile Events: Following mobile events, Luggage Drop will return all unretrieved items to our brick and mortar facility closest to the mobile event. Unretrieved items are subject to additional daily storage fees when appropriate. Customers can make arrangements with Luggage Drop to ship their property to them at the customer’s expense.

Retrieving Items After the Event: If you fail to retrieve your items by the designated close time of the event, you must retrieve them from our store located at 501 Union Street, Nashville, TN 37219. Our store is open from 9am until 6pm and you can pick up your items during these hours. If you are unable to pick up your items during these hours, you can make other arrangements by calling 615-802-3500.

Insurance: Luggage Drop insures every bag, its contents, and personal items that are paid for, up to $2,500 per bag. Property stored at the courtesy of Luggage Drop, for which a storage fee was not paid, nor held within an insured bag will not be insured.

Modification of Terms: Luggage Drop reserves the right to modify these terms and conditions at any time. Any such modifications will be effective immediately upon posting on our website or app. It is your responsibility to review these terms and conditions regularly and to be aware of any modifications. Your continued use of our services after any modifications indicates your acceptance of the modified terms and conditions.

Governing Law: These terms and conditions and your use of our services shall be governed by and construed in accordance with the laws of the State of New York, United States, without giving effect to any principles of conflicts of law.
